Rental Agreement in Bengaluru: A Practical Guide for Owners and Tenants
Most rental disputes we see in East Bengaluru do not begin with a bad tenant or a difficult owner. They begin with a vague agreement — a deposit amount with no refund terms, a rent figure with no revision clause, or no inventory of what was handed over. A clear, properly stamped rental agreement protects both sides and saves months of argument later. Here is what owners and tenants should understand before they sign.
Why most Bengaluru agreements run for 11 months
Under Section 17 of the Registration Act, 1908, a lease of immovable property from year to year, or for any term exceeding one year, must be compulsorily registered. Agreements for a shorter period do not have to be registered, which is why the 11-month agreement has become the common practice for residential flats in Bengaluru. It keeps the paperwork simple and allows both parties to review terms each year.
Owners and tenants who want a longer, more secure arrangement — for example, a family planning to stay three to five years — can choose a longer lease, but should then register it at the jurisdictional Sub-Registrar office and budget for the higher stamp duty and registration charges that apply.
Stamp duty: do not skip it
Even an unregistered 11-month agreement must be executed on adequately stamped paper under the Karnataka Stamp Act, 1957. For agreements up to one year, the duty commonly applied is 0.5% of the average annual rent plus the deposit, subject to a ceiling of ₹500. Longer leases attract higher duty, and the rates differ by term. Stamp duty can be paid through e-stamp paper; please confirm the current rate and payment method with the Department of Stamps and Registration (IGR Karnataka) or your advocate at the time of signing, as rules are revised from time to time.
An under-stamped document can be impounded and may not be accepted as evidence until the deficit duty and penalty are paid — a poor bargain for a saving of a few hundred rupees.
Security deposit and rent revision
Bengaluru is known for high rental deposits, often six to ten months’ rent for an unfurnished flat. The Karnataka Rent Act, 1999 does not cap the deposit for new agreements, and Karnataka has not yet adopted the central Model Tenancy Act, 2021, which proposes a two-month limit for residential premises. In practice, the deposit is whatever the owner and tenant agree — so the terms of its return matter more than the amount.
There is also no fixed legal cap on rent increases in Bengaluru. Any revision should be written into the agreement: the percentage (many agreements use a fixed annual escalation) and when it applies on renewal.
Clauses every rental agreement should have
- Parties and property: full names, addresses and ID details of owner and tenant; flat number, building, and the e-Khatha or property identification details.
- Term and lock-in: start date, duration, any lock-in period, and the notice period either side must give (one to two months is typical).
- Rent and due date: monthly rent, due date, mode of payment, and the penalty (if any) for late payment.
- Deposit refund: amount, the timeline for refund after vacating, and what may be deducted — for example, unpaid dues or damage beyond normal wear and tear. Painting charges should be stated clearly rather than left to argument.
- Maintenance and utilities: who pays apartment association maintenance, electricity (BESCOM), water and gas, and who handles minor and major repairs.
- Use and occupancy: residential use only, restrictions on subletting, pets, or structural changes, and compliance with association bye-laws.
- Inventory annexure: a signed list of fittings, furniture and appliances, ideally with dated photographs, attached to the agreement.
- Witnesses and signatures: signed by both parties on every page, with two witnesses.
Tips for owners
- Verify the tenant’s identity and employment, and complete tenant verification with the local police as per the current procedure.
- Collect rent and deposit through bank transfer so there is a clear record.
- If you live abroad, appoint a trusted representative through a properly executed power of attorney to sign and manage the tenancy.
Tips for tenants
- Confirm that the person signing is the owner or holds valid authority — ask to see a recent tax receipt or Khatha document.
- Read the deposit-refund and painting clauses carefully before paying any advance.
- Keep the original stamped agreement and rent receipts; they are useful for address proof and for claiming HRA where applicable.
- Do a joint walk-through at move-out against the inventory list to avoid deduction disputes.
Key takeaways
- Leases exceeding one year must be registered; 11-month agreements need not be, but must still be properly stamped.
- Karnataka does not cap rental deposits, so write clear refund terms and permitted deductions.
- Put rent revision, notice period, maintenance and repair responsibilities in writing.
- Attach a signed inventory with photographs to prevent move-out disputes.
